< 조선민주주의인민공화국에 있어서의 인권의 상황 >

총회(UN 총회)는
유엔의 회원 국가들이 인권(인간의 권리)과 기본적인 자유들을 증진하고 보호하고 그들이(국가회원들이) 여러 가지의 국제적 기구들에서 약속한 의무들을 수행하기위해서 의무가 있다는(의무를 가지고 있다는) 것을 재확인하면서,

조선민주주의인민공화국은 시민의 권리와 정치적 권리에 관한 국제적 협약, 경제적, 사회적, 그리고 문화적 권리에 관한 국제적 협약, 아동의 권리에 관한 국제적 협약, 그리고 여성들에 대한 모든 형태의 차별들의 제거에 관한 협약을 염두에 두고 (마음에 두고),

인권위원회의의 2003년 4월 16일의 결의안 2003/10, 2004년 4월 15일의 결의안 2004/10, 2005년 4월 14일의 결의안 2005/11, 이러한 결의안들을 상기하면서 (되돌아보면서),

2005/11 결의안(2005년 4월 14일의 결의안)에서
만일 북한정부가 조선민주주의인민공화국에서 인권의 상황에 관한 유엔인권위원회의 특별 보고관에게 협력을 하지 않고, 또 만일에 북한에서의 인권 상황의 개선이 관찰되지 않는다면,
유엔인권위원회는 유엔총회가 조선민주주의인민공화국에서 인권 상황의 문제를 거론라고 처리할 것을 촉구했던 것을 특별히 상기하면서,

(유엔총회는) 특별보고관의 보고의 기록을 살피면서

1. (유엔총회는) 다음의 사항들에 깊은 관심을 표현한다.

(a) 조선민주주의인민공화국에서 인권상황에 대한 유엔인권위원회의 특별보고관의 임명을 인정하여야 할 조선민주주의인민공화국의 거부 혹은 그리고 그에게 (특별 보고관에게) 협조하여야 할 조선민주주의인민공화국의 거부(거절), (에 유엔 총회는 깊은 관심을 표한다)

(b) 아래의 사항([1]에서 [5]까지)들을 포함한 조선민주주의인민공화국에서 인권의 조직적이고 폭넓은 그리고 중대한 위반들에 대한 계속적인 보고들 (에 유엔총회는 깊은 관심을 표한다)

[1] 고문 그리고 다른 잔인한 비인간적인 혹은 인간의 품위를 떨어뜨리는 대우(처우) 혹은 처벌, 공개적인 사형집행, 사법절차를 무시한 임의로 하는 (제멋대로의) 구속, 정당한 절차와 법치(법이 지배)의 부재(不在), 정치적 이유로 사형이라는 벌의 부과, 수많은 감옥들의 존재와 강제 노동의 광범위한 실행 (에 유엔총회는 깊은 관심을 표한다.)

[2] 북한 시민들이 국경이탈(탈북)을 반역죄로 처리하고 구금, 고문, 잔인하고, 비인간적인 혹은 인간의 품위를 떨어뜨리는 처우벌 혹은 사형이라는 처벌에 이르게 하는 외국에서 송환되어 온 조선민주주의인민공화국 시민들에게 부과되는 제재(制裁)들 (에 유엔총회는 깊은 관심을 표한다.)

[3] 사상, 양심, 종교, 의견과 표현, 평화적 집회와 결사의 자유들에 대하여 그리고 정보에 대한 평등한 접근에 대하여 전반적이고 심각한 제한들과 국내에서 그리고 해외로 자유롭게 이동하기를 원하는 모든 사람들에 대하여 부과된 제한들 (에 유엔총회는 깊은 관심을 표한다.)

[4] 특별히 창녀를 시키려는 목적으로 여성들의 인신매매(밀거래) 혹은 강요된 혼인, 강요된 낙태(유산), 그리고 경찰 수용소와 집단수용소에서 살해를 포함해서 송환되어 온 어머니들의 아이들의 살해(영아살해)

(에 유엔 총회는 깊은 관심을 표한다.)
[5] 강요된 행방불명의 형태로 외국인들의 납치와 관련된 미해결의 문제들 (에 유엔총회는 깊은 관심을 표한다,)

2 (유엔 총회는) 다음과 같은 것에 관심을 표한다

유엔 인권고등 판무관이 조선민주주의인민공화국의 당국자들과 이러한 관점에서 대화를 하려는 노력에도 불구하고 조선민주주의인민공화국 정부는 유엔 인권 고등판무관과 그녀(고등판무관이 여성)의 사무실과 전문적인(특수한) 협조활동에 참여하고 있지 않다는 것 (에 유엔 총회는 관심을 표한다.)

3 (유엔 총회는) 북한에서 위험한 인도적인 상황에 아직도 상당한 비율의 아동들이 육체적 이고 정신적인 성장에 영향을 주는 특별히 영아의 영양실조(불량)의 널리 퍼짐(만연 蔓延)에 유엔 총회의 깊은 관심을 표한다.

4. 인도적 지원(지원 물자)가 인도주의적인 원칙들에 일치하게 필요를 토대로 공명정대하게 배달(전달)되고 있는 것을 그들이(UN기구들이) 확신하도록 하기위하여
(유엔 총회는) 조선민주주의인민공화국 정부가 이러한데 주의하면서 인도주의적 기구들(조직들)이 비정부조직(NGO)들과 유엔의 기구들을 포함해서 특별히 세계식량계획(WFP) 이 조선민주주의인민공화국의 모든 지역들에 대하여 완전하고, 자유롭고, 안전하고, 방해받지 않는 접근 권을 가질질 수 있도록 확보하여 줄 것을 촉구한다,

이러한 관심은 2006년 1월부터 인도주의적 지원(물자)를 접수하지 않겠다는 그들의 의도에 대한 조선민주주의인민공화국의 당국자들의 발표로 심화되어 왔기 때문이다.

5. (유엔총회)는 조선민주주의인민공화국 정부가 인권과 기본적인 자유들을 완전히 존중할 것을 촉구하고, 이러한 관점애서 유엔 인권위원회의 앞에서 언급된 결의안들에서 정해진 조치들을 특별히 유엔 특별 보고관과의 충분한 협조로 완전히 실행할 것을 또한 촉구한다.

Situation of human rights in the Democratic People's
Republic of Korea

The General Assembly,

Reaffirming that States Members of the United Nations have an obligation to
promote and protect human rights and fundamental freedoms and to fulfil the
obligations that they have undertaken under the various international instruments,
Mindful that the Democratic People's Republic of Korea is a party to the
International Covenant on Civil and Political Rights,1 the International Covenant on
Economic, Social and Cultural Rights,1 the Convention on the Rights of the Child2
and the Convention on the Elimination of All Forms of Discrimination against
Women,3
Recalling Commission on Human Rights resolutions 2003/10 of
16 April 2003,4 2004/13 of 15 April 2004,5 and 2005/11 of 14 April 2005,6

Recalling in particular that in its resolution 2005/11, the Commission on
Human Rights urged the General Assembly to take up the question of the situation
of human rights in the Democratic People's Republic of Korea if the Government
did not extend cooperation to the Special Rapporteur of the Commission on the
situation of human rights in the Democratic People's Republic of Korea and if
improvement of the situation of human rights in the country was not observed,

Taking note of the report of the Special Rapporteur,7

1. Expresses its serious concern at:

(a) The refusal of the Government of the Democratic People's Republic of
Korea to recognize the mandate of the Special Rapporteur of the Commission on
Human Rights on the situation of human rights in the Democratic People's Republic
of Korea or to extend cooperation to him;

(b) Continuing reports of systemic, widespread and grave violations of
human rights in the Democratic People's Republic of Korea, including:

(i) Torture and other cruel, inhuman or degrading treatment or punishment,
public executions, extrajudicial and arbitrary detention, the absence of due
process and the rule of law, the imposition of the death penalty for political
reasons, the existence of a large number of prison camps and the extensive use
of forced labour;

(ii) Sanctions imposed on citizens of the Democratic People's Republic of
Korea who have been repatriated from abroad, such as treating their departure
as treason, leading to punishments of internment, torture, cruel, inhuman or
degrading treatment or the death penalty;

(iii) All-pervasive and severe restrictions on the freedoms of thought,
conscience, religion, opinion and expression, peaceful assembly and
association, and on equal access to information and limitations imposed on
every person who wishes to move freely within the country and travel abroad;

(iv) Continued violation of the human rights and fundamental freedoms of
women, in particular the trafficking of women for the purpose of prostitution
or forced marriage, forced abortions, and infanticide of children of repatriated
mothers, including in police detention centres and camps;

(v) Unresolved questions relating to the abduction of foreigners in the form
of an enforced disappearance;

2. Expresses its concern that the Government of the Democratic People's
Republic of Korea has not engaged in technical cooperation activities with the
United Nations High Commissioner for Human Rights and her Office, despite
efforts by the High Commissioner to engage in a dialogue with the authorities of the
Democratic People's Republic of Korea in this regard;

3. Expresses its deep concern at the precarious humanitarian situation in the
country, in particular the prevalence of infant malnutrition, which still affects the
physical and mental development of a significant proportion of children;

4. Urges the Government of the Democratic People's Republic of Korea, in
this regard, to ensure that humanitarian organizations, including non-governmental
organizations and United Nations organizations, in particular the World Food
Programme, have full, free, safe and unimpeded access to all parts of the
Democratic People's Republic of Korea in order that they may ensure that
humanitarian assistance is delivered impartially on the basis of need in accordance
with humanitarian principles, this concern having been aggravated by the
announcement by the authorities of the Democratic People's Republic of Korea of
their intention not to accept humanitarian assistance from January 2006;

5. Also urges the Government of the Democratic People's Republic of
Korea to fully respect all human rights and fundamental freedoms and, in this
regard, to implement fully the measures set out in the above-mentioned resolutions
of the Commission on Human Rights, in particular full cooperation with the Special
Rapporteur.
